Terms of Service

These Terms of Service ("Terms") govern your use of the IntervalGuide mobile application ("the App") developed and published by Tremia ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Use of the App
IntervalGuide is a fitness interval timer application with optional heart rate monitoring capabilities. You may use the App for personal, non-commercial fitness and training purposes. You agree not to:
- Reverse engineer, decompile, or disassemble the App or any part thereof
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Modify, adapt, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App
2. Health Disclaimer
IMPORTANT: IntervalGuide is NOT a medical device. The heart rate data displayed in the App is provided for informational and fitness purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or health condition.
You should always consult a qualified healthcare professional before starting any exercise program or making health-related decisions. Do not rely solely on heart rate data from IntervalGuide for medical or health decisions. The accuracy of heart rate readings depends on the external Bluetooth heart rate monitor used and is not guaranteed by Tremia.
Tremia expressly disclaims all liability for any health-related decisions, injuries, or adverse health events that may result from the use of the App or reliance on its data. You use the App and any connected devices entirely at your own risk.
3. Intellectual Property
The App, including its design, code, graphics, icons, user interface, and all content, is the intellectual property of Tremia and is protected by applicable copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved by Tremia.
4. Subscriptions & In-App Purchases
IntervalGuide offers an optional premium subscription that removes advertisements and unlocks additional features. Subscriptions are processed through Google Play and are subject to Google Play's Terms of Service.
- Subscription fees are charged to your Google Play account upon confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage and cancel your subscription through Google Play (Google Play > Subscriptions > IntervalGuide > Cancel)
- Refunds are handled by Google Play in accordance with their refund policies
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Tremia does not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, reliability, or completeness of any heart rate data or other information provided through the App.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TREMIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL TREMIA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO TREMIA FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.
7. Termination
We reserve the right to terminate or suspend your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to Tremia, other users, or third parties. Upon termination, your right to use the App ceases immediately.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.
9. Changes to These Terms
We may modify these Terms at any time by posting the updated Terms on this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
10. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany and applicable European Union regulations, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Germany.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
